Hello Forum Members,
I apologise firstly for writing in English. I do speak and read Dutch, but I find writing Dutch a little more challenging.
I am English, and when I came to Holland to work in October 2008 I rented a 4 bedroom link house in Leidschenveen. I had to pay 1595 Euro rent in advance, 1595 Euro makelaars provisie, 1595 Euro deposit, and 250 Euros per month deposit for gas, electricity etc. and 500 euros per month furniture rental. I've been told many times during the last year that I have been ripped off.
Question One: Do the forum members agree and what steps should I take?
I decided to leave the house in September and two of my english colleagues agreed to rent the house provided the rent was reduced. The estate agent asked them to sign a six month rental agreement, which they did, she would then try to renegotiate the rent and furniture rent with the owner. That was six weeks ago and my colleagues have not heard from the agent since and have now decided to leave the house.
Suddenly the agent now says that the rental agreement is binding untill april 2011. (I have not seen the rental agreement, but presumably the rent amount has been left blank as it was then not yet determined.
Question Two:
Could any forum members offer advice as to the rights of my colleagues?

The rent is quite high, but "expat rents" are always high.
Deposits are supposed to be returned. If they haven't been returned, you obviously should take action. Same for the advance.
I don't think you can do much about the rent (1595 + 500). You agreed to it when signing the contract, and it's not the duty of the landlord to inform you about the normal price level.
The provision is probably acceptable if it was you that hired the makelaars and they helped you find the apartment (and the landlord was not a client of theirs). If you only reacted to an offer on the makelaars' website (for example), then they should have charged the landlord and not you.
(Obviously the agents made a nice profit from the 1595 euro, but usually they only charge if they succeed in finding you an apartment, and it's not uncommon that people hire 4 or 5 makelaars. So when you pay, you make up for the free service they have provided to other clients. People like "gratis" here, and they pay dearly for that.)

So they have signed a contract, while orally agreeing that the signed contract was not yet binding? Unless they can somehow prove this oral agreement, it seems quite impossible to get out of the contract. Or unless indeed the rent amount was left blank and they have a signed copy which shows this. _________________ Hanc marginis exiguitas non caperet. |

i strongly advise u to find a dutch lawyer and ask him/her to look over your case.
In dutch law the person who rents a house is quite well protected.
with the information u gave here i cannot say how much chance u have, but looking at the amounts of money involved, i would at least make an appointment with a lawyer.
