This is an intensive program that will provide you with:
• An understanding of the negotiation “best practices” that have been established through several decades of empirical research
• Hands-on exercises through which to begin translating that understanding into skills
While clients and principals expect lawyers to know how to negotiate, lawyers have rarely received any education or training about how to go about it. As a consequence, lawyers often negotiate the way they think they are supposed to, or the way that they think will impress their clients or principals. Such approaches may or may not be effective - and may even inadvertently cause conflict to be exacerbated – and since there is usually no way for the lawyer to determine whether he or she is being effective, or is being as effective as possible, bad habits are never corrected and new skills are rarely developed.
They rather than in a way that primarily is to be effective, imitate what they have seen other lawyers do.
Purpose of this training
The purpose of this workshop is to develop your negotiation skills by providing you with:
• An understanding of the negotiation “best practices” that have been established through several decades of empirical research;
• Hands-on exercises through which to begin translating that understanding into skills; and
• Opportunities to share experiences with fellow lawyers.
Through a stimulating mix of simulations, lectures, reflective small group discussions, and question-and-answer sessions, the workshop will enable you to:
• Learn about the theory and practice of effective negotiation
• Develop your negotiation skills
• Learn about your personal conflict style and gain the self-awareness that will allow you to change counterproductive approaches and unconscious habits
• Discover self-management techniques to avoid unnecessary escalations of conflict
• Understand the well-documented cognitive phenomena that lead people to perpetuate conflicts rather than resolve them
• Understand the role that mediation can play in overcoming those predictable barriers to resolving conflicts
This workshop is intended for all lawyers, regardless of experience.
Voor deze training hebben wij een trainer uit Amerika. Deze training wordt daarom hoofdzakelijk in het Engels gegeven. Om onduidelijkheden te voorkomen en het stellen van vragen aan Allen Zerkin te vergemakkelijken, is gedurende de hele dag een tweede, Nederlandstalige, docent aanwezig.

Allen J. Zerkin
(Juris Doctor, Yale Law School, 1972) has been teaching conflict management and negotiation courses at New York University’s Wagner Graduate School of Public Service since 1988. He has led the popular one-day workshop on negotiation at the American Planning Association’s Annual Conference since 1999 and has just conducts a new two-day workshop for the Association on conflict management, negotiation, mediation, consensus building and public involvement. He is a member of the faculty of the ‘Amsterdams ADR Instituut’, teaching the advanced negotiation course for lawyers. The focus of his professional practice is the mediation of public controversies. He has been a member of the New York State Bar Association since 1977.
Felix Merks
Felix Merks is oprichter en algemeen directeur van Result ADR. Hij heeft een achtergrond in procurement, corporate sales en business development & strategy in het internationale bedrijfsleven. Hij is een ervaren mediator (NMI-gecertificeerd) en is een veel gevraagd gastspreker over de ontwikkeling van Mediation en Arbitrage in Nederland. Felix Merks is afgestudeerd in Nederlands recht te leiden, volgde de postdoctorale opleiding ADR voor juristen bij het Amsterdams ADR Instituut en behaalde een Masters in Dispute Resolution aan de Universiteit van Amsterdam (cum laude). Vervolgens volgde hij een opleiding tot trainer in onderhandelvaardigheden aan Harvard Law School
