The research program on Human Rights of the Erasmus University of Rotterdam has the pleasure to invite you to a workshop on a most compelling and topical question: “Conflicts of Fundamental Rights before the European Courts”.
This takes place on the 7th of March at the EUR, between 13 and 18 hours. The workshop will be held in the M-building location M1-19 (Athene).
Conflicts of fundamental rights have proven to be a problem of all times, that has come more to the fore in recent years. As there is no formal hierarchy of fundamental rights, there are no ready made answers to problems of conflicting rights. Different jurisdictions do not necessarily deal with this in the same way.
In view of the increasing prominence of fundamental rights within EC law, it seems most interesting to study how conflicting rights are being addressed by the European Court of Justice (ECJ), while comparing that to the approach of the other European Court, the European Court of Human Rights (ECHR).
As keynote speaker we have a guest from the European Court of Justice, namely Advocate General Miguel Poiares Maduro.
This is followed by a reaction by dr Allard Knook (focusing on the ECJ) and professor Rick Lawson (who will also relate this to the jurisprudence of the ECHR). Finally professor Wilhelmina Thomassen, the previous Dutch judge at the ECHR will discuss this difficult question.
As the program reveals: each presentation will be followed by a short discussion of about 10 minutes, but there will be time to have a full and more elaborate discussion at the end of the program.
The workshop is free of charge, but registration is mandatory. The deadline for registering is February 29th. This seminar will be conducted in English. There will be a reception at the end of the day.
