Mijn aanstaande ex-vrouw heeft mij bij het scheiden meegedeeld dat ze het maximale uit de scheiding zal proberen te halen. Hierbij gebruikte ze inderdaad de term Donald Trump-achtige scheiding.
Nu is bij de zitting ter vaststelling van de voorlopige alimentatie inderdaad gebleken dat ze hier haar best voor gaat doen. Voor haar en onze 7-jarige dochtertje eiste ze 1500 resp. 780 euro. Voor mij een onmogelijk op te brengen bedrag met mijn netto inkomen van op dit moment ongeveer 3300 euro, gedwongen in een huurhuis in de privé sector en een forse schuld uit het huwelijk.
Hoe kan ik, en mijn advocaat hier het beste verder mee omgaan? Wat is de beste strategie in deze?
Wie kan mij een tip geven?

Haar eis zal gebaseerd zijn op berekeningen van behoefte en draagkracht. Jij moet onderbouwd aanvoeren dat haar behoefte minder is en/of dat jouw draagkracht minder is, en dat haar berekeningen dus niet kloppen. _________________ Hanc marginis exiguitas non caperet. |

Bad luck - you've got an exwife like mine who views the end of the marriage and indeed basically the marriage itself in retrospect as a financial asset only, to be plundered to her advantage and to your disadvantage. Perhaps she also is driven by vindictiveness (like mine as well, even though she was the one to break up the marriage). It also sounds like she, like mine, has chosen one of the more US-style local lawyers who are in it for a vechtscheiding....
Anyway, I'm sorry my answer is in English, but I hope you can follow it OK.
To get an idea of likely amounts you can go to www.alimentatiewijzer.nl where you can input your netto income. If you do this it gives a kinderalimentatie of 519 per month. I believe this is quite accurate - it's linking to the Tremanormen income- and age-dependent tables. It does as you will see on the website also depend on your exwife's income. The website must also make an assumption about your living costs etc. and other deductible expenses. The court has a rule of thumb (apparently) that any rent or mortgage interest up to about one third of your netto income is reasonable - above that they might not include part of it in the calculation. The 780 figure for your daughter sounds like the top of the table, which is only valid for netto family income of 5000 Euro or more.
The judge should in theory only award higher kinderalimentatie if there is a case of handicap, unusually high childcare costs, high education costs or "topsport".
As for the partneralimentatie, the website guideline (assuming your exwife doesn't work and based on its other built-in assumptions) for need is 1768/month. I can't imagine your draagkracht will come anywhere near that, or even anywhere near the 1500 she's demanding. If you can get your monthly debt repayments included that will help too, but your lawyer will need to be convincing and plenty of supporting documents indicating what it's related to will be necessary.
The algorithm works like this. You have to live and a rent up to 1100/month can in principle deducted. Then there is the bijstandsnorm (ca. 900 I think) of which 200 or so will be allocated to your rent, so only about 700 gets deducted. You are then always allowed to make deductions for health insurances and disability etc. insurance premiums as well as commuting costs for work or other costs you can show are absolutely necessary for your work. Another (pathetically small) cost that will always be deducted is 5 Euros per child per day that your child(ren) live(s) with you. Then the debt repayments might get deducted if you are lucky. If your rent is about 1100, say, and your insurances about 200, commuting costs about 50 (might be much higher, just guessing) then you're looking at deductions of around 2100 or so without the debts, leaving 1200 available for support. They can take up to 70% of this for the KA now with the change in the law, so under that scenario you'd be looking at the full 519/month for your daughter if your exwife doesn't work. Then there's a few hundred left over for your exwife. The tax-deductability of the PA makes the calculation complicated but based on all the above assumptions my wet finger estimate would be close to half what she's demanding. The lawyers all have an elaborate kind of spreadsheet software that handles all this.
Does your exwife work? If not try your best to prove that she could at least work part-time and that from the time your daughter is 12 full-time so that the PA (if there still is any) goes (or at least goes down significantly) and with luck the KA qutie a bit too. |
