hoi,

ik wil eerst even zeggen dat ik er niet zeker van ben of dit wel de juiste plek is voor mijn vraag. (sorry daarvoor).

wat ik graag wil weten is of er iemand is die weet wat de 'Mirandawaarschuwing' inhoudt?
ik kwam dat begrip tegen in een boek van Mary Higgins Clark en had er nog nooit eerder over gehoord.
ook op zoekmachines kon ik er niets over vinden.

hopelijk heeft er iemand antwoord op mijn vraag.

Het is dan ook een Amerikaanse term, zie Miranda warning.

US Supreme Court schreef:

...The person in custody must, prior to interrogation, be clearly informed that he has the right to remain silent, and that anything he says will be used against him in court; he must be clearly informed that he has the right to consult with an attorney and to have that attorney present during interrogation, and that, if he is indigent, an attorney will be provided at no cost to represent him.

In andere woorden:

You have the right to remain silent. Anything you say can and will be used against you in a court of law. You have the right to speak to an attorney, and to have an attorney present during any questioning. If you cannot afford a lawyer, one will be provided for you at government expense.

Huiswerkvraag: welk recht wordt hier aan de verdachte toegekend dat hij in Nederland niet zou hebben?

Je ziet (hoort) het ook wel eens in Hollywood films.

Zo zegt James Belushi in de rol van Det. Sgt. Art Ridzik in de film Read Heat (1988) het volgende:

Overigens heet het de Miranda-warning omdat het arrest waarin het Supreme Court dit uitspraak Miranda v. Arizona was.

Toevallig kom ik een verhaal over meneer Miranda tegen:
